Kaliyoga may, at its sole discretion, offer alternative dates or a booking credit, but shall be under no obligation to do so.
CANCELLATION BY KALIYOGA
Kaliyoga intends to honour every confirmed booking and would only cancel a venue hire in circumstances where it is unable to provide the venue as agreed.
Kaliyoga may need to cancel a booking where:
(a) payment obligations are not met;
(b) the Leader materially breaches the Booking Agreement or these Terms & Conditions; or
(c) the proposed retreat activities present unacceptable safety, legal, reputational or operational risks.
Where cancellation results from a breach or non-payment by the Leader, the applicable cancellation charges shall remain payable.
If Kaliyoga has to cancel a booking for reasons other than a breach or non-payment by the Leader, the Leader will first be offered the opportunity to transfer the booking, together with all payments already made, to alternative dates that are reasonably suitable to both parties.
If alternative dates cannot be agreed, Kaliyoga will refund all payments made in respect of the booking, including the deposit.
This does not affect any separate rights or obligations that may arise under the Force Majeure provisions of these Terms & Conditions.
FORCE MAJEURE
Neither party shall be liable for failure to perform obligations caused by events beyond its reasonable control, including but not limited to:
Natural disasters;
Flood;
Fire;
Wildfire;
Pandemic;
Epidemic;
War;
Civil unrest;

Transportation disruption.
Kaliyoga may modify schedules, substitute services, alter activities or make other operational changes reasonably required by such circumstances.
If a Force Majeure event prevents the retreat from proceeding as planned, Kaliyoga will contact the Leader as soon as reasonably practicable and the parties will explore suitable alternative dates or arrangements.
Where alternative dates are agreed, payments already made will be transferred to the rearranged booking. Where alternative arrangements cannot be agreed, the parties will deal with any remaining payments and obligations in accordance with the circumstances and applicable law.
FINAL PARTICIPANT NUMBERS
The Leader shall provide final participant numbers and rooming requirements no later than twenty-one (21) days before the Arrival Date.
Kaliyoga may allocate accommodation, staffing and catering arrangements based upon those final numbers.
Unless otherwise agreed in writing, a reduction in participant numbers after the final numbers deadline does not reduce the Total Booking Value.
DIETARY REQUIREMENTS
All dietary requirements, allergies and food intolerances must be submitted no later than twenty-one (21) days before the Arrival Date.
The Leader is responsible for ensuring that Kaliyoga receives accurate and complete information relating to participants’ dietary requirements.

DAMAGE TO PROPERTY
The Leader shall be responsible for damage caused by participants, leaders, contractors or guests attending the retreat, other than reasonable wear and tear.
Participants are asked not to use tanning oils, self-tanning products or other cosmetic products on beds, towels or other Kaliyoga linen where they may cause permanent staining.
Where linen or towels are stained or otherwise damaged by such products and the staining cannot be removed through the normal laundry process, Kaliyoga may recover the reasonable cost of replacement from the Leader.

The Leader shall ensure that leaders, teachers, therapists, coaches, practitioners, guides, contractors and other service providers engaged by the Leader maintain such qualifications, licences, permits, certifications and insurance cover as may be appropriate to the services they provide and as may be required by applicable law, professional standards or industry practice in their profession and jurisdiction.
